Arbitration and Remote Arbitration

is a relatively modern mechanism adopted by most arbitration centers to reduce
time and costs through simplified procedures. The concept of expedited
arbitration is based on speed and procedural simplicity, aiming to 
 ensure an arbitration award is issued within a relatively short period.
<p class="MsoNormal" style="text-align:left;margin:0in 9pt 0in 4.5pt;line-height:normal;background-image:initial;background-position:initial;background-size:initial;background-repeat:initial;background-attachment:initial;background-origin:initial;background-clip:initial;"> 
<p class="MsoNormal" style="text-align:left;margin:0in 9pt 0in 4.5pt;line-height:normal;background-image:initial;background-position:initial;background-size:initial;background-repeat:initial;background-attachment:initial;background-origin:initial;background-clip:initial;">Most leading
arbitration centers have established rules for expedited arbitration, including
short timelines, simplified procedures, lower costs, and limited or no
hearings. The process also includes the swift appointment of the
arbitrator—usually a sole arbitrator rather than a three-member tribunal. The
final arbitration decision is typically issued within three to six months from
the date the arbitration case is referred to the arbitrator unless the parties
agree otherwise.

<p class="MsoNormal" style="text-align:left;margin:0in 9pt 0in 4.5pt;line-height:normal;background-image:initial;background-position:initial;background-size:initial;background-repeat:initial;background-attachment:initial;background-origin:initial;background-clip:initial;">In 2021, the United
Nations Commission on International Trade Law (UNCITRAL) introduced expedited
arbitration rules in 16 articles. Key provisions include:
<p class="MsoNormal" style="text-align:left;margin:0in 9pt 0in 4.5pt;line-height:normal;background-image:initial;background-position:initial;background-size:initial;background-repeat:initial;background-attachment:initial;background-origin:initial;background-clip:initial;"> Both parties
must agree to apply the UNCITRAL Expedited Arbitration Rules (Article 1).
<p class="MsoNormal" style="text-align:left;margin:0in 9pt 0in 4.5pt;line-height:normal;background-image:initial;background-position:initial;background-size:initial;background-repeat:initial;background-attachment:initial;background-origin:initial;background-clip:initial;"> A sole
arbitrator is appointed unless the parties agree otherwise (Article 7).
<p class="MsoNormal" style="text-align:left;margin:0in 9pt 0in 4.5pt;line-height:normal;background-image:initial;background-position:initial;background-size:initial;background-repeat:initial;background-attachment:initial;background-origin:initial;background-clip:initial;"> The arbitration award
must be issued within six months from the tribunal's formation unless extended
under exceptional circumstances, with a maximum extension of nine months
(Article 16).
<p class="MsoNormal" style="text-align:left;margin:0in 9pt 0in 4.5pt;line-height:normal;background-image:initial;background-position:initial;background-size:initial;background-repeat:initial;background-attachment:initial;background-origin:initial;background-clip:initial;"> The World Intellectual
Property Organization (WIPO) also introduced expedited arbitration rules in
2021. These rules specify that: A sole arbitrator handles the dispute
(Article 14).
<p class="MsoNormal" style="text-align:left;margin:0in 9pt 0in 4.5pt;line-height:normal;background-image:initial;background-position:initial;background-size:initial;background-repeat:initial;background-attachment:initial;background-origin:initial;background-clip:initial;"> Hearings must be
concluded within three months of the later of  the defense submission or
the tribunal's formation, whichever occurs later.
<p class="MsoNormal" style="text-align:left;margin:0in 9pt 0in 4.5pt;line-height:normal;background-image:initial;background-position:initial;background-size:initial;background-repeat:initial;background-attachment:initial;background-origin:initial;background-clip:initial;"> The arbitration award
should be issued in the following month, subject to reasonable feasibility.
<p class="MsoNormal" style="text-align:left;margin:0in 9pt 0in 4.5pt;line-height:normal;background-image:initial;background-position:initial;background-size:initial;background-repeat:initial;background-attachment:initial;background-origin:initial;background-clip:initial;"> As of January 15,
2024, the Cairo Regional Centre for International Commercial Arbitration
(CRCICA) implemented new rules. Annex (2) outlines emergency arbitrator
procedures, while Annex (3) introduces expedited arbitration procedures. Key
provisions include:
<p class="MsoNormal" style="text-align:left;margin:0in 9pt 0in 4.5pt;line-height:normal;background-image:initial;background-position:initial;background-size:initial;background-repeat:initial;background-attachment:initial;background-origin:initial;background-clip:initial;">If arbitration has not
commenced or the tribunal is not yet formed, a party may request emergency
measures from CRCICA. The emergency arbitrator must issue a decision within 15
days from receiving the request, unless extended under exceptional circumstances.
<p class="MsoNormal" style="text-align:left;margin:0in 9pt 0in 4.5pt;line-height:normal;background-image:initial;background-position:initial;background-size:initial;background-repeat:initial;background-attachment:initial;background-origin:initial;background-clip:initial;">For expedited
arbitration, parties must explicitly agree to apply CRCICA's expedited
arbitration rules. If these rules no longer apply, the tribunal continues under
standard CRCICA arbitration rules.

appointed unless the parties agree otherwise (Article 6).

must be issued within six months from the tribunal’s formation unless extended
by CRCICA under justified circumstances (Article 11).

arbitration emphasizes speed and cost reduction, remote arbitration—also known
as "electronic arbitration" or "online arbitration"—becomes
an optimal solution.

a relatively modern approach driven by advancements in communication
technology. It enables arbitrators, disputing parties, witnesses, and experts
to participate in the arbitration process using digital communication tools
without being physically present in one location. This differs from traditional
arbitration, where all parties meet face-to-face, similar to courtroom
proceedings.
<p class="MsoNormal" style="text-align:left;margin:0in 9pt 0in 4.5pt;line-height:normal;background-image:initial;background-position:initial;background-size:initial;background-repeat:initial;background-attachment:initial;background-origin:initial;background-clip:initial;"> The Use of  some
electronic methods (such as email exchanges) in arbitration does not
necessarily classify it as online arbitration.

remote arbitration include:

and arbitrators are in different countries, virtual hearings eliminate travel
delays.

Avoiding travel expenses, accommodation costs, and logistical fees
significantly lowers overall arbitration costs.

drawback is the risk of cybersecurity breaches. Hackers may compromise the
confidentiality of arbitration proceedings, which is a critical advantage of
arbitration in general. To mitigate this risk, encryption protocols and
high-security anti-hacking software should be employed.

arbitration trends, we recommend amending Egypt’s Arbitration Law No. 27 of
1994 to explicitly incorporate provisions on expedited arbitration and remote
arbitration. This would align with Egypt’s Vision 2030 and support sustainable development
goals centered on peace, justice, and strong institutions.

landscape in Egypt. At 40 years old, Dina holds a Bachelor’s degree in Law from
Cairo University, along with a Diploma in Public Law and a Master’s degree in
Litigation Logistics, in addition to numerous academic courses in legal and
political fields. 
  
Dina began her professional journey as a legal advisor for the Association of
Public Prosecutors and Courts, where she provided vital legal consultations
that helped improve the legal conditions for employees in the judiciary sector.
In a move to further develop her skills and enhance her impact in the media
sector, she took on the role of legal advisor for the United Media Services
Company, where she assisted in managing legal affairs related to media and
advertising. 
  
In addition to her professional achievements, Dina El-Mokadem is a member of
the Arab Lawyers Union and continues to serve as a legal advisor to numerous
companies and factories. She is also affiliated with the International
Academics Union and the Youth Coordination of Political Parties and
Politicians. 
  
Since 2011, Dina has been actively engaged in politics, participating in
various events and political parties, and sharing her views through multiple
articles. Through this work, she aims to create a positive impact on her
community and demonstrates a commitment to improving conditions for the better. 
  
Behind her success lies an inspiring personal story. Dina grew up in the Sayeda
Zeinab neighborhood until she was ten years old, after which she moved to
Kuwait with her mother following her father's abandonment of his
responsibilities. During this period, her mother took on the sole responsibility
of raising Dina and her brother, a significant challenge for a mother facing
this situation alone in a foreign country. 
  
Dina faced life’s challenges early on, starting with working at the age of
seventeen to support her mother. Her experiences included working in areas far
from law, such as selling household goods, training at computer companies, and
working in real estate. 
  
Despite these challenges, Dina managed to balance work and study, and with
God's grace, she graduated from university and continued her legal training
successfully. She took on numerous public interest cases, demonstrating her
strong will and resilience in the face of difficulties. 
  
Dina describes her journey as never easy, filled with hardships and obstacles,
which made her view it as a sacred journey marked by pain, weakness, and
challenges. However, with divine support, she managed to persevere and achieve
notable accomplishments in this vital field. 
  
In her personal ambitions, Dina focuses on making a positive difference in the
lives of others. She states that her goal is to create a sustainable positive
impact, evident in every step she takes toward achieving this aim. Her deep
belief that every individual has the ability to improve their circumstances and
overcome challenges reflects her determination and resolve. 
  
Dina advises young people not to surrender to difficult circumstances and
obstacles, emphasizing that God has given us the intellect, energy, and health

This usually relates to the issue of "unfair competition," where if sarcasm clearly damages the reputation of a competing brand, it may face legal repercussions, including compensation or even cease-and-desist orders. 
This is based on criteria such as whether the sarcasm violates professional and commercial ethics. On the other hand, the right to freedom of expression must be considered. In this context, sarcasm can be an effective tool for promoting products, provided it does not cross red lines. 
Here, legal issues arise in determining whether the use of sarcasm constitutes a culpable act of unfair competition or if it is simply an exercise of the right to freedom of expression. The question arises about the standard that allows the judge to determine the dividing line between sarcasm as an act of unfair competition and as a mere expression of freedom. 
In our opinion, it is necessary to consider these aspects collectively and come up with data that shows whether this act entails punishment and compensation or not. These can be summarized in the following criteria: 
 
1. Social and cultural context of the society.
2. Questioning the competing brand.
3. Direct attack on the brand.
4. Confusion and misinterpretation by consumers.
5. Ambiguity that may negatively affect the brand's reputation.
6. Proportionality between the strength of the brands in terms of fame.
7. Use of deceptive means.
8. Extent of impact on consumers.
Based on this, business owners and marketers need to think about how sarcasm is used and how it can affect the overall image of the brand, considering the values and principles that the brand aims to embody and the commercial reputation it builds as a result. 
Finally, a crucial question arises that we must consider: Can we consider sarcasm in competition, in and of itself, innovative?
